Golden Giving Limited, whose registered office is at 85 Great Portland Street, London, W1W 7LT (Companies House registration number 06688164), trading as People's Fundraising ("PF"), operates https://fundraising.groundswell.org.uk (the "Website"). People's Fundraising provides a digital fundraising platform enabling individuals, groups, and Nonprofits to create and manage fundraising pages, accept donations, process Gift Aid, sell products and memberships, run events, raffles and lotteries (where enabled), manage crowdfunding campaigns, and operate online charity shops. These Terms and Conditions govern your use of all Website features and associated services. Please read them carefully. If you do not agree to these Terms and Conditions, you must not continue to use the Website.

These Terms and Conditions may change or be updated from time to time. It is your responsibility to check these Terms and Conditions whenever you access the Website. The latest version will govern any future use of the Website.

Regulatory and Legal Compliance

You agree to comply with all applicable UK laws and regulatory requirements while using the Website, including (where relevant):

  • The Charity Commission's guidance for trustees and fundraising activities (for example CC20).
  • The Fundraising Regulator's Code of Fundraising Practice.
  • The Gambling Act 2005 and any associated licensing or registration requirements for raffles or lotteries.
  • The Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 when selling goods, services or tickets.
  • Data protection legislation including UK GDPR and the Data Protection Act 2018.
  • Applicable anti-money laundering laws and regulations (for example, Money Laundering Regulations 2017), sanctions screening rules, and wider financial crime prevention requirements.

Nonprofits and users fundraising on behalf of an organisation warrant they are authorised to do so and agree to act in accordance with all applicable laws and guidance.

Eligibility and Account Creation

By creating an account on the Website, you warrant that you are at least 18 years of age. If you are under 18, you may only use the Website to create a fundraising page or event under the direct supervision and written consent of a parent or legal guardian.

You agree to provide true, accurate, current, and complete information when registering an account. You must maintain and promptly update this information.

If you are registering or creating a fundraising page on behalf of a Nonprofit or organisation, you confirm that you have authority to bind that organisation to these Terms and Conditions.

About the featured Nonprofits

The Website enables you to donate to, raise funds for, or otherwise support any Nonprofit, community group, club, or organisation listed on the platform. Each participating Nonprofit enters into an agreement with us authorising PF to collect donations, process payments, and where eligible, reclaim Gift Aid on its behalf under the UK Government's Gift Aid scheme. Nonprofits must be registered with the Charity Commission, OSCR, the Charity Commission for Northern Ireland, HMRC, or otherwise be eligible to receive charitable funds. We also support organisations not eligible for Gift Aid; these are clearly listed as such.

Refunds

We will refund duplicate donations or donations made in error provided the donor requests a refund on the same day the donation was made. For refund requests made outside this period, please contact the relevant Nonprofit or organisation directly, as they are responsible for managing such requests.

Use of your donation

People's Fundraising acts solely as a platform provider and payment intermediary. We are not responsible for how a Nonprofit uses the funds it receives. Unless expressly stated by the Nonprofit, donations may be used for its general charitable purposes. We cannot guarantee that contributions will be restricted to a specific campaign unless explicitly confirmed by the Nonprofit.

Fees and Financial Handling

We charge a transaction fee on payments made through the Website, and our payment service providers may apply their own fees. Details are available at Our Fees. A charge of £25 is made where transfers fall outside standard transfer schedules or where incorrect bank details provided by a Nonprofit result in failed transfers.

Fund Payouts: Funds raised, net of fees and any associated payment processing costs, are typically transferred to the designated Nonprofit or account holder on a regular schedule (for example, monthly). This schedule is subject to verification, fraud checks, and payment processor clearance.

Right to Withhold, Offset, or Recover Funds: PF reserves the right to temporarily withhold, delay, or reverse payments in cases of suspected fraud, chargebacks, legal or regulatory compliance requirements (for example, sanctions screening), or where the Nonprofit/User is in breach of these Terms and Conditions. Furthermore, you authorise PF to offset, deduct, or recover from any outstanding balance or future transfers any amounts owed by the Nonprofit/User to PF, including (without limitation) chargeback fees, reversal costs, or fines incurred by PF due to the Nonprofit's activities or breach of these Terms. PF may also change its fee structure upon providing reasonable notice (for example, 30 days) on the Website.

Payment processing and disbursement of funds are handled through regulated payment providers. Donations are held in designated accounts until disbursed to the intended recipient. PF may require identity verification ("Know Your Customer") before releasing funds. We reserve the right to delay or refuse disbursement of funds if required to fulfil our legal obligations, including anti-fraud and anti-money laundering checks, or if identity verification fails. We may report suspected criminal or fraudulent activity to appropriate authorities.

All card and payment information is handled by PCI-DSS compliant payment service providers. PF does not store full card or bank details on its systems.

Specific Platform Activities (Events, Sales, Lotteries, Crowdfunding, Auctions)

If you utilise the Website to create or manage specific campaign types, the following special conditions apply:

Raffles and Lotteries

If you operate a raffle or lottery (where enabled), you are solely responsible for ensuring compliance with all applicable laws, including the Gambling Act 2005 and any licensing or registration requirements of the Gambling Commission or local authorities. PF acts only as a technology platform and accepts no liability for any failure to comply with these laws. PF may suspend or terminate any page deemed non-compliant.

By law, individuals under the age of 16 (or 18 where applicable) must not participate in lotteries or raffles. You are responsible for implementing appropriate age verification measures to prevent underage participation.

Events and Product Sales (E-commerce)

If you sell tickets, merchandise, or memberships, the Nonprofit or User creating the sales page is the seller of record. The seller is solely responsible for:

  • Compliance with consumer protection laws (including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013), including cancellation rights for eligible buyers.
  • Product/service quality, fulfilment, delivery, and any associated taxes (for example, VAT).
  • Handling all customer service queries, including specific refunds, returns, and dispute resolution for sales/tickets.

PF is not liable for any issues arising from the quality, delivery, cancellation, or legality of products, memberships, or events.

Auctions

If you operate an auction via the Website, you are responsible for listing, fulfilment, and legal compliance (including applicable auction and consumer law). You must deliver items or benefits promised to the highest bidder in accordance with your stated terms and any applicable law, and you are responsible for resolving any disputes with bidders. Unless you clearly state otherwise in your listing, bids may be treated as legally binding offers.

Crowdfunding

The terms of your crowdfunding campaign (including funding targets, timelines and whether funds are released if the target is not met) must be clearly stated on your campaign page. PF is not responsible for the successful execution or outcome of the campaign, nor for any promises or representations made by the campaign owner.

Unauthorized card use

When a donation or payment is made on the Website, the transaction is final unless unauthorised use of your payment card is proven. If you suspect fraudulent use, or if your card has been lost or stolen, you must notify your card provider immediately.

Protecting your password

When you create an account on the Website, you must keep your password confidential. You are responsible for all activity that occurs under your account. If you become aware of unauthorised access, you must change your password immediately. We encourage the use of strong passwords and, where available, two-factor authentication.

Gift Aid information

When you make a donation and confirm that you are a UK taxpayer in accordance with the Gift Aid scheme requirements, PF will reclaim Gift Aid from HMRC on behalf of the benefiting Nonprofit. You are responsible for ensuring that your Gift Aid declaration is accurate. We cannot provide legal or tax advice; you should consult your own advisers for guidance on your tax position.

Privacy

The Privacy Policy forms part of these Terms and Conditions. By using the Website, you confirm that you have read and understood how your personal data is collected, processed, stored, shared, and protected as described in our Privacy Policy.

You must comply with UK data protection laws when accessing or processing donor or supporter information provided through the platform. This includes acting as an independent data controller for such information and fulfilling all relevant legal duties.

User conduct

You must use the Website and its services responsibly and legally. In particular, but not exclusively:

  • You must not upload or post content that incites violence, terrorism, extremism, discrimination or illegal activity.
  • You must not upload content that violates any applicable laws, including charity fundraising regulations, financial crime rules, the UK Equality Act 2010, or FATF guidance.
  • You must not infringe intellectual property rights.
  • You must not upload malware, viruses or harmful code.
  • You must not upload false, misleading, fraudulent or deceptive content, or impersonate others.
  • You must respect the rights and privacy of others and ensure you have permission to upload any personal data, images or media.
  • You must comply with all data protection requirements when handling donor or supporter information provided through your fundraising, membership, shop or event pages.
  • You must not use the Website for any illegal or unauthorised purpose, including unlicensed lotteries, fraudulent activities, or financial wrongdoing.

Failure to comply may result in suspension or termination of your account, removal of content, reporting to relevant authorities, and/or legal action.

If you create a fundraising page, event, crowdfunding campaign, shop, membership product or any other content on the Website, you are responsible for ensuring its accuracy and legality. PF may remove material at its sole discretion where content is inappropriate, unlawful, misleading, unsafe or in breach of these Terms and Conditions.

Links

The Website contains links to third-party websites. Inclusion of a link does not constitute endorsement. Your relationship with those websites is your own responsibility.

Partner services

From time to time we may provide links or access to partner services. Although we aim to work with reputable partners, we are not responsible for their actions, services or content.

Intellectual Property & Content Licence

All content owned by PF on the Website is protected by copyright. The names People's Fundraising, peoplesfundraising.com, associated logos, and branding may not be used without prior written permission.

Other trademarks appearing on the Website belong to their respective owners and may not be used without permission.

All PF-owned content on the Website may only be used for personal, non-commercial purposes unless express permission is granted.

Grant of Content Licence

When you upload or post content (including text, photos, videos, etc. – User Content) to the Website, you retain all ownership rights in your User Content. However, by uploading content, you grant PF a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to use, reproduce, modify, display, and distribute your User Content in connection with the Website and for the promotion of the Website and its services, in any media formats and through any media channels.

User Warranties: You warrant that you own or have the necessary licences, rights, consents, and permissions to grant the above licence to PF. You also warrant that your User Content does not infringe the intellectual property, privacy, or other rights of any third party.

PF may retain copies of fundraising pages, events, crowdfunding campaigns, shops, membership products, and other User Content, including after removal or campaign closure, for a reasonable period for purposes of audit, regulatory compliance, fraud prevention, and historical transparency, in line with our Privacy Policy.

You acknowledge that any personal data you choose to include in public User Content (for example on fundraising pages, events, shops or membership products) is disclosed at your own discretion and may be visible to other users and the public. You are responsible for ensuring you have all necessary rights and permissions to include such personal data.

Changes to the service

We may modify, suspend or discontinue any part of the Website at any time without notice. New features are subject to these Terms and Conditions.

Failure to comply and Account Suspension

If you breach these Terms and Conditions, PF may, at its sole discretion, immediately suspend or permanently block your access to the Website and associated services. In the event of suspension or termination due to a breach, PF reserves the right to:

  • Remove any content you have posted.
  • Withhold, delay, or permanently retain funds associated with the breach, particularly where fraud, illegal activity (for example, unlicensed lottery), or a significant chargeback risk is involved, until the matter is resolved with relevant authorities or parties.
  • Report the activity to the relevant authorities (including the Charity Commission, HMRC, or police).

Complaints and Dispute Resolution

If you wish to raise a complaint about your experience with the Website, please contact us at support@peoplesfundraising.com. We aim to resolve issues in accordance with Fundraising Regulator guidance.

If you are not satisfied with our response, you may refer your complaint to the Fundraising Regulator or the UK Information Commissioner's Office (ICO) for privacy-related concerns.

Termination

You may stop using the Website at any time. These Terms and Conditions continue to apply to past use.

Indemnification

You agree to indemnify, defend, and hold harmless Golden Giving Limited (trading as People's Fundraising) and its directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including, without limitation, reasonable legal fees) arising out of or in connection with:

  • Your use of the Website and services, including any transaction, event, or campaign you operate.
  • Your breach of these Terms and Conditions.
  • Any claim by a third party that your User Content or activities infringe their rights (including IP or privacy rights).
  • Your failure to comply with any applicable laws, including tax, consumer protection, or gambling laws (especially regarding raffles/lotteries).

Disclaimer and limitation of liability

Nothing in these Terms and Conditions excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.

The Website is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free or secure access. Maintenance and updates may occur periodically.

Subject to legal exceptions, we are not liable for any loss or damage arising from use of the Website, including indirect or consequential losses, loss of profits, loss of data, or loss of opportunity.

Governing law

These Terms and Conditions are governed by English law and subject to the exclusive jurisdiction of the English courts.

Third party rights

A person who is not a party to these Terms and Conditions has no rights to enforce them under the Contracts (Rights of Third Parties) Act 1999, except where required by law or regulatory body.
